What is an uncontested divorce? An uncontested divorce is generally a divorce that the two parties agree on. They work out the specifics of their assets and split them up according to mutual agreements outside of court. With an uncontested divorce, there is no alimony, child support, or custody issues. Once a couple has decided to have an uncontested divorce, they need to put their agreement in writing and present it to their local courthouse. If the court deems that the agreement is fair for both parties, they grant the couple a divorce. An uncontested divorce is also quicker and the couple does not need to wait as long until it becomes final. How do I go about filing for a divorce? To file for divorce without your spouse knowing, simply go to the courthouse and fill out the appropriate paperwork. The best way to make sure that you do everything the right way is to hire a lawyer to file your papers. If you’re unsure about how your spouse will react, a lawyer will help you get the entire process taken care of, and your spouse will have no knowledge of it until the papers are served. If your spouse gets angry easily, this could be the best thing to do because it allows you to be away from home when the papers get served, preventing any confrontation. I’ve heard of common-law marriages. Is there such a thing as common-law divorce? No, there is not such a thing as common law divorce. You cannot be granted a divorce simply by living apart from your spouse for an extended period of time. Most states required, at the very least, a written agreement submitted to the court that states your intention to divorce each other or of your intent to separate from each other. In most states, common law marriage is a recognized form of marriage. This is not so with divorce, though. If you both agree to a divorce, contact a lawyer or your county courthouse to find out the very least you need to do to be granted a divorce. It is only a few weeks before my divorce will become final. Would it be illegal for my spouse to marry again before it has become officially complete? Legally, yes it is. Being married to more than one person at once is against the law. You cannot marry another person until your divorce is absolutely final, as this would break state bigamy laws. But this is just a formality. Many states would not regard the second marriage as purposefully breaking the law. If your spouse gets married before the final divorce hearing, you could try to get them in trouble for committing bigamy, but most likely nothing would come of it because neither the lawyers nor the court system actively pursues these cases. I have just filed for divorce. How long will it be before it is final? If you have filed for an uncontested divorce, the entire ordeal can be over in a matter of a few weeks. If you have a disputable divorce, on the other had, it could be quite awhile before the divorce is officially final. If you have children together, some states require a waiting period before actually filing the divorce papers. The court’s schedule also plays a major role in how long the divorce will take. If they have many cases to go through, you may be waiting awhile. If you talk to the court clerk, they might be able to give you an idea about how long it will be. Employment Law Solicitors, Martin Kaye are the first company in Telford to use the Healthy Hearts Campaign’s new mobile health screening facility in a bid to assist employees in monitoring their health. Diabetes and cardio-vascular risks can now be identified with a 30 minute pop-in pop-out check at work.

A West Midlands law firm is the first company in Telford to take part in a health screening campaign for its staff.

The screening will include cholesterol, blood pressure and blood sugar analysis, as well as a general physical examination, a lung function test, and heart checks.

‘The Healthy Hearts Institute is based at Sandwell Medical Research Unit at West Birmingham Hospitals NHS Trust, and has already been piloted across the West Midlands.

Healthy Hearts Campaign Co-ordinator, Geraldine Thomas, said: ‘Our mobile screening facility travels between industrial estates, business parks, and office blocks, and is run by a team of health professionals.

‘Hundreds of staff have benefited from the state-of-the-art check-ups, and now the screening programme is being extended to Shropshire.

Martin-Kaye Solicitors, who are based in Telford, have signed up to the Healthy Hearts Campaign, in a bid to help employees find out more about the state of their health.

The mobile screening unit will visit the company’s offices on November 15, and every employee who attends the session will receive a 30-minute consultation to assess their condition, with the results explained in private afterwards.

Senior Partner, Graham Davies, said: ‘We are extremely pleased that our staff are backing the Healthy Hearts initiative, and that they’re keen to take up this opportunity – in fact over 70 per cent of our employees have signed up to take part.

‘At the heart of every company is its workforce and we want to help our employees to identify any potential risks so they can seek the right kind of treatment, which should help prevent problems in the future.’

Healthy Hearts, Geraldine Thomas, said: ‘We are delighted to see such a high level of interest from a wide range of companies, who are all taking the view that health screening in the workplace benefits not only the employee, but the company too.’

Healthy Hearts is a charitable social enterprise initiative which encourages access to health screening, particularly with regard to cardio-vascular health risks and diabetes. Is it possible for someone to take over your payments and you avoid foreclosure? There are several problems that arise which make it difficult, unless the person taking over the payments is a family member who doesn’t mind doing the favor of making your payments. The mortgage contract was made between you and the lender and there isn’t a way for you to simply let someone take over payments and get you off the hook. However, before foreclosure if someone buys the home from you, there might be a way for the mortgage company to pay off your portion and create a new mortgage with the new party.

Foreclosure is worse then bankruptcy because you are actually losing something of value, your home. It usually takes 110-120 days or more for the foreclosure process to be completed. Most loan documents (Deed of Trust) have a power of sale clause authorizing the lender to conduct a foreclosure auction to sell the defaulted borrower’s property. If there is no cure of the default, a Notice of Foreclosure Sale (NFS) is recorded. You figure and report gain or loss from a foreclosure or repossession in the same way as gain or loss from a sale or exchange.

Property in foreclosure is often referred to as distressed property because the owner is in financial distress and has usually missed several mortgage payments. Distressed assets (such as foreclosed property or equipment) are considered by some to be worthwhile investments because the bank or mortgage company is not motivated to sell the property for more than is pledged against it. These properties are usually priced below market and you get to inspect the property and can usually finance the property through the bank that did the foreclosure.

Mortgage lenders typically lose money when they foreclose, since most foreclosed homes are worth less than the value of the mortgage. The mortgage holder can usually initiate foreclosure anytime after a default on the mortgage. Under strict foreclosure, when a mortgagor defaults, a court orders the mortgagor to pay the mortgage within a certain period of time. Virtually all mortgages today have acceleration clauses.

Bidding at a foreclosure sale can be VERY tricky. Obviously, no lender will be interested in doing a Short Sale as long as the borrower is just one or two installments behind on payments. Last, but certainly not least, is the fact that you must pay all cash at most foreclosure sales. If you have not left the property after the law date or sale of the property, the court will allow the bank to have a marshal move you out.

Foreclosure is worse because of the loss of value – over a short time. Foreclosure is NOT a single event, but a legal process that takes time. When the foreclosure is completed, the derogatory record can stay in your credit reports for up to 10 years.
