Journalist, counselor, painter, and US 2012 Presidential candidate Joe Schriner of Cleveland, Ohio took some time to discuss his campaign with Wikinews in an interview.

Schriner previously ran for president in 2000, 2004, and 2008, but failed to gain much traction in the races. He announced his candidacy for the 2012 race immediately following the 2008 election. Schriner refers to himself as the “Average Joe” candidate, and advocates a pro-life and pro-environmentalist platform. He has been the subject of numerous newspaper articles, and has published public policy papers exploring solutions to American issues.

Yesterday, Swiss footballer Xherdan Shaqiri joined Liverpool FC on a “long-term contract”, the English Premier League club announced via their official website. According to multiple reports, Liverpool exercised the £13 million release clause in his contract with Stoke City.

26-year-old Shaqiri joined Stoke in August 2015 from Italian club Internazionale for a reported fee of £12 million. In three seasons at Stoke City, Shaqiri made 84 league appearances scoring fifteen goals, 92 appearances in all competitions for The Potters. Last season, Stoke City were relegated to the EFL Championship.

Shaqiri was the third signing of Liverpool this season. Club’s manager Jürgen Klopp said, “I think the English phrase to explain the decision to sign Xherdan is a ‘no-brainer'”. Klopp went on to say, “I know him well from his time in Switzerland and especially Germany — I have been a long-time admirer. But the added bonus now is that he knows the Premier League and what it takes to perform in this uniquely intense environment.”

Before playing in England, Shaqiri played for FC Basel in Switzerland, Bayern Munich in Germany, as well as for Internazionale. He won six league titles with Basel and Bayern, as well as the UEFA Champions League with Bayern in 2013, defeating Borussia Dortmund in the finals which were then managed by Jürgen Klopp.

Internationally, Shaqiri has scored 21 goals in 74 appearances. In this year’s FIFA World Cup, Shaqiri played all four matches, before losing out to Sweden in the Last 16 knockout phase. He scored one goal in the tournament, a 90th-minute winner against Serbia.

Klopp also said of Shaqiri, “He has speed and ability, has the right amount of arrogance on the football pitch, real bravery to want the ball and influence things”.

After signing the contract, Shaqiri said, “As a player, you always want to be on the biggest stage in football. A few years ago I wanted to come too but it didn’t happen. I’m really happy that now I’m finally here. I want to improve myself too, I want to be with the best and I want to win titles. That’s what I’m here for.”

Shaqiri has been allocated jersey number 23. This season, Liverpool has signed Naby Keita from RB Leipzig and Fabinho from AS Monaco.

A Continental Connection flight from Newark to Buffalo crashed into a house about four to six miles from Buffalo Niagara International Airport on Thursday night, killing 50 people, officials said.

Continental Airlines Flight 3407 is a daily commuter flight from Newark Liberty International Airport in Newark, New Jersey to Buffalo, New York, operated under the Continental Connection brand by Virginia-based regional airline Colgan Air.

The Buffalo News has reported that the plane, a Bombardier Dash 8 turboprop with tail number N200WQ has crashed into a home located at 6038 Long Street, not far from the Clarence Center Fire Hall in the Buffalo suburb of Clarence Center approximately 10:17 p.m. EST (03:20 UTC), Thursday, February 12, 2009. Three people were inside the house.

According to Becky Gibbons of New York State Police and Chris Collins County Executive in Erie County, New York, the total number of fatalities is 50, including 45 passengers, four crew members and a person on the ground, while a woman and daughter on the ground were injured, near the edge of farmland, about seven miles from Buffalo Niagara International Airport.

Karen Wielinski, age 57, and her daughter, Jill, age 22 were brought to Millard Fillmore Suburban Hospital in Williamsville where they are in stable condition in the emergency room. The father, Douglas C. Wielinski, 61 died from his injuries. Two volunteer firefighters are also being treated for smoke inhalation and minor injuries. They are expected to be released later Friday morning.

The crew member names have been released as of 8:20 AM EST, and are listed as: Captain Marvin Renslow, First Officer Rebecca Shaw, Flight Attendant Matilda Quintero, Flight Attendant Donna Prisco, and Captain Joseph Zuffoletto who was an off-duty crew member.

One of the crash victims, Beverly Eckert, of Stamford, Connecticut and widow of 9/11 terror attack victim, Buffalo native, Sean Rooney, was coming home for her husband’s 58th birthday celebration. Her sister, Sue Bourque noted to The Buffalo News, “We know she was on that plane and now she’s with him.” Chris Kausner has said his sister Elise, age 24, a law student, was on board the plane. “I’m thinking about the fact that my mother has to fly home from Florida and what I’m going to tell my two sons,” he said.

The plane, which was carrying over 2.5 tonnes (5,000 pounds) of fuel, impacted a residence that was completely destroyed. Amid rain and sleet, the ill-fated plane exploded into a huge orange fireball, sparking a large fire which emergency crews had to contain. Twelve houses near the crash site were evacuated.

The aircraft in question was on approach to land at the nearby Buffalo Niagara International Airport when it disappeared from radar.

According to recordings from air traffic control, the pilot did not report any problem to approach control, and could not be contacted by the Buffalo tower after handoff. “Can other planes see anything?” asked the traffic controller, but no one has responded. The pilot’s last comment was “Colgan Flight 3407,” but there were no sounds of distress.

The Buffalo News has reported that crew members aboard the flight from Newark Airport reported mechanical problems as they approached Buffalo. Weather conditions were reported to be a wintry mix in the area, with light snow, fog, and 17 mile per hour winds.

In the 31-minute audio-recording there are conversations between the cockpit, air traffic control and other aircraft in the vicinity. Following take-off from Newark Airport, a female voice (pilot) in the 3407 plane’s cockpit is heard informing air authorities that her aircraft was turning on approach to landing. The pilot stopped communicating at 2,300ft.

“This aircraft was 5 miles out, all of a sudden we have no response from that aircraft,” the controller declares. 21 minutes and 45 seconds into the recording, the control tower informs a JetBlue Airlines: “…apparently we have an emergency, I’ll have to get back to you,” reported The Daily Telegraph.

“It was cold, snowing and dark but these planes are designed to fly in icy conditions. However, those conditions can be very fickle and if ice builds up on a plane it can be very difficult. At this time of year, when a pilot crashes approaching an airport that they will know well, the first thing you look at is the weather,” said David Learmount, of Flight International.

Continental Airlines Inc. said Colgan Air was in the process of collecting information. “Continental extends its deepest sympathy to the family members and loved ones of those involved in this accident. We are providing our full assistance to Colgan Air so that together we can provide as much support as possible for all concerned,” said Larry Kellner, CEO of Continental Airlines since December 2004.

The Bombardier Dash 8 a 74-seat is a twin-engined, medium range, turboprop airliner.

According to the Ascend Online Fleets database, Colgan, a company of about 1,100 employees has a fleet of 15 Bombardier Dash 8’s, along with 3 Hawker Beechcraft 1900D and 38 Saab 340B turboprops. Flight 3407’s airplane was less than one year old and had flown for only about 1,500 hours, said Kieran Daly, of the online aviation news service Air Transport Intelligence, saying that the doomed turboprop plane is one of the safest of its type.

Scandinavian Airlines (SAS) has permanently grounded its Dash 8s fleet after three crash landings during a two-month period in 2007 caused by faulty landing gear. “Confidence in the Q400 has diminished considerably and our customers are becoming increasingly doubtful about flying in this type of aircraft,” said Mats Jansson, SAS president and CEO. “I have decided to immediately remove Dash 8 Q400 aircraft from service,” he added.

“There is ‘no indication of any security related event’ that brought the plane down,” said FBI spokesman Richard Kolko. Conditions of freezing drizzle, known as hard rime, were the most likely cause of the tragedy.

The National Transportation Safety Board (NTSB) has announced that they would send a team to the crash site on Friday to begin the investigation. Lorenda Ward will serve as chief investigator with the assistance of NTSB Commissioner Steven Chealander and public affairs officer Keith Holloway. Ward has investigated several other plane crashes — including the 2006 New York City plane crash that claimed the life of New York Yankees pitcher Corey Lidle.

“We are deeply shocked and saddened by the tragic accident that occurred tonight in Clarence. Our focus right now is on supporting the first responders on the ground and their efforts to ensure the health and safety of people in the area,” said Chris Lee, an Republican politician from Corning, New York, representing the 26th Congressional District of New York.

The tragedy is the nation’s deadliest disaster since the Comair Flight 191 crashed in Lexington, Kentucky in August 2006. Delta Air Lines Flight 5191 was a scheduled U.S. domestic passenger flight from Lexington, Kentucky, to Atlanta, Georgia. On the morning of August 27, 2006, the Bombardier Canadair Regional Jet 100ER that was being used for the flight crashed while attempting to take off from Blue Grass Airport in Fayette County, Kentucky, four miles (6 kilometers) west of the central business district of the City of Lexington.

Financially, Continental is faced with volatile fuel prices amid a slowdown from the weak economy. It has posted losses of $585 million for 2008.

An article in the February 12 issue of the New England Journal of Medicine reports on an unusual cause for an outbreak of low blood sugar among men in Singapore: illegal use of sexual performance enhancement drugs that were contaminated with a diabetes drug.

Between January and May 2008, 149 men and one woman between 19 and 97 (mean age 51) were admitted to five public hospitals for unexplained low blood sugar. Similar cases were reported in media reports from Hong Kong. Seven Singaporean patients remained in a coma because of prolonged sugar starvation of the brain, and four subsequently died. The diabetes drug glyburide was found in blood and/or urine samples in 85% of cases; 30% admitted having used illegal sexual performance enhancers.

The contaminated products were a counterfeit version of the drug Cialis (meant for the treatment of genuine erectile dysfunction), and three purported herbal preparation (the affected brands included Power 1 Walnut and Santi Bovine Penis Erecting Capsule). All four preparations additionally contained Viagra in varying concentrations. Two herbal products contained traces of the weight loss drug sibutramine, a compound related to amphetamines.

The drug packaging mentioned names of non-existent overseas production facilities, so the source of the contamination with the diabetes drug could not be established.

The authors underline the risks that is known to be associated with purchasing drugs from unreliable providers or from online resellers. The clandestine use of impotence drugs as sexual performance enhancers seems to have provided a good illustration of this problem. They further call for more efforts by national and international health and law enforcement agencies to curb the manufacturing, international transport and sales of untrustworthy medication.

The 2010 Susan G. Komen St. Louis Race for the Cure, held earlier today in St. Louis, Missouri, became the world’s largest Race for the Cure, with over 71,000 participants.

2010 marks the twelfth year for the race in St. Louis, which raises money for breast cancer research nationwide. Originally brought to the city in 1999, it has raised over US$19 million. It was sponsored by Wells Fargo Advisors, a locally-headquartered brokerage firm of the financial services provider Wells Fargo. Nationally, the Race for the Cure is hosted by Susan G. Komen for the Cure, a non-profit organization supporting breast cancer research.

In 1999, there were only about 10,000 participants in the St. Louis Race for the Cure. In recent years, the number has grown to over 60,000, and today’s 5K race saw over 71,000 runners, walkers, and wheelchair racers. Despite the heat and humidity, 1,090 teams signed up, and over 4,500 breast cancer survivors participated. Overall, the race raised more than US$3.3 million. A phone bank set up by Wells Fargo and local television station KSDK contributed over US$28,000 of that amount in four hours.

Prior to the race, there was a parade of all the breast cancer survivors who had signed up for the race. The actual competition began at 8:30 a.m. CDT (1330 UTC) with the wheelchair race. Following them were the timed runners, the untimed runners, the walkers, and lastly, the “fun walk” participants, who had only opted to walk one mile (1.6 kilometres).

The Komen St. Louis Race for the Cure is only one of many Races for the Cure, which is the largest group of 5K runs and walks in the world. The first Komen race was held in 1983 in Dallas, Texas, but has since spread to over 140 cities throughout the world. Proceeds from today’s St. Louis race will benefit both local institutions and the rest of the United States. At least 25 percent of the money raised will go toward funding national research on breast cancer, while the rest will be given to organizations in St. Louis for breast cancer awareness programs.

The 28th Taipei Audio Video Fair (TAVF), organized by the Taipei Electrical Commercial Association (TECA), featured not only some innovative domestic market exhibition ideas, but also offered a pavilion entitled the “Global Audio and Video History Corridor”, to showcase the audio and video industry’s world-wide history. Wikinews reporter Rico Shen attended the fair, which, this year, highlighted TECA’s 60th anniversary.

At the Taipei Grand Hotel (Yuanshan Hall), some participants (exhibitors) rented soundproof guest rooms, which offered the best quality and performance for audio experiences. With high-definition television becoming a popular topic, some pre-market or marketed wide-screen HDTVs featuring 1080p were exhibited at the Taipei World Trade Center (TWTC Hall).

The TAVF show runs from November 8 to 12, closing at 8:00 p.m. (Taipei Time) each night except November 12, which has a closing time of 6 p.m. To assist visitors from The Grand Hotel, TWTC and TECA hired the Metropolitan Transport Corporation for an inter-hall shuttle service. The peak number of visitors are expected to be on the weekend after permitting minors under 120 cm to enter the showground.

American political commentator Glenn Beck has lost his case against a satirical website which parodies him, in a ruling from the World Intellectual Property Organization (WIPO) in Geneva, Switzerland. The website argued Beck’s actions to shut it down were an attempt to silence free speech. On Friday, the website’s creator sent a letter to Beck saying he would voluntarily turn over the domain name to him.

Florida resident Isaac Eiland-Hall created the website in September, and it asserts Beck uses questionable tactics “to spread lies and misinformation”. The website was represented in the case Beck v. Eiland-Hall by free speech lawyer Marc Randazza. Wikinews interviewed Randazza for the article “US free speech lawyer Marc Randazza discusses Glenn Beck parody”, and previously reported on the case in articles, “US free speech lawyer defends satire of Glenn Beck” and “Satirical website criticizes Glenn Beck for ‘hypocritical’ attempts to silence free speech”.

Eiland-Hall registered the website at the domain “www.GlennBeckRapedAndMurderedAYoungGirlIn1990.com”. Its premise was derived from a joke statement made by Gilbert Gottfried about fellow comedian Bob Saget. Users of the Internet discussion community Fark first applied the joke to Beck, and it then became popular on several social media sites. Eiland-Hall saw the discussion on Fark, and created a website about it. The website asserts it does not believe the rumors to be true, commenting, “[b]ut we think Glenn Beck definitely uses tactics like this to spread lies and misinformation.” The website was created on September 1, and just two days later attorneys for Beck’s company Mercury Radio Arts took action. Beck’s lawyers sent letters to the domain name registrar where they referred to the domain name itself as “defamatory”, but failed to get the site removed.

Beck filed a formal complaint with the Switzerland-based agency of the United Nations, WIPO, who operate under regulations laid out by the Internet Corporation for Assigned Names and Numbers. Beck asserted the website’s usage is libelous, bad faith, and could confuse potential consumers. Beck’s complaint was filed under the process called the Uniform Domain Name Dispute Resolution Policy. This policy allows trademark owners to begin an administrative action by complaining that a certain domain registration is in “bad faith”. Beck argued the site should be shut down because it is an infringement upon his trademark in his own name, “Glenn Beck”.

Eiland-Hall retained Randazza as his attorney after receiving threatening letters from legal representatives of Beck. On September 28, Randazza filed a response brief to WIPO, contending the site is “protected political speech”, due to it’s “satirical political humor”. Randazza stated, “even an imbecile would look at this Web site and know that it’s a parody.” Randazza’s brief commented on Beck’s style of reporting, and highlighted a controversial statement made by him when interviewing a Muslim US Congressman. Beck said to Representative Keith Ellison, “I like Muslims, I’ve been to mosques. … And I have to tell you, I have been nervous about this interview because what I feel like saying is, sir, prove to me that you are not working with our enemies.” According to the Citizen Media Law Project, the website’s joke premise takes advantage of “a perceived similarity between Beck’s rhetorical style and the Gottfried routine”.

Randazza argued in the response filed on behalf of Eiland-Hall that Beck attempted to use the process of the WIPO court to infringe the free speech rights of his client; “Beck is attempting to use this transnational body to circumvent and subvert the Respondent’s [web site owner] constitutional rights [to freedom of speech],” he wrote. Randazza cited the U.S. Supreme Court case, Hustler Magazine v. Falwell, in arguing that Beck’s attorneys advised him against filing legal action in a U.S. court because the website would likely be seen as a form of parody and due to the First Amendment to the U.S. Constitution, such legal action would not be successful.

On September 29, Randazza sent a request to Beck’s representatives, asking that their client agree to stipulate to the United States Constitution, and especially to the First Amendment, during the case before the WIPO. In the request, Randazza quoted a statement from Beck himself about the usage of international law by United States citizens, Beck said, “[o]nce we sign our rights over to international law, the Constitution is officially dead.” In an October 19 interview with Wikinews, Randazza stated that Beck had not replied to his request to stipulate to the U.S. Constitution and the First Amendment in the WIPO case.

On October 20, Randazza filed a surreply – a response document to an October 13 supplementary filing made by Beck in the case. Attorneys for Beck asserted in the supplementary filing that the joke made by the website is difficult to comprehend, and therefore the domain name is confusing. In Beck’s supplementary filing, his lawyers argued, “While there is absolutely nothing humorous or amusing about the statement made by Respondent in his domain name that ‘Glenn Beck Raped and Murdered a Young Girl in 1990,’ the average Internet user finding the domain name GlennBeckRapedAndMurderedAYoungGirlin1990.com (“Disputed Domain Name”) in a search would have no reason not to believe that they will be directed to a website providing factual information (as opposed to protected criticism or similar protected speech) about Mr. Beck.”

Randazza’s surreply asserted, “An average Internet user might not ‘get the joke’. In fact, the average Internet user does not understand any internet memes. That’s the fun of a meme – it is an esoteric inside joke that will leave most people scratching their heads.” In Randazza’s conclusion to the Eiland-Hall surreply, he called Beck “the butt” of a joke he apparently does not understand. Randazza wrote that Beck “should be deeply ashamed” for devaluing the First Amendment to the U.S. Constitution.

For Beck to have prevailed in the case, the WIPO arbitrator would have needed to rule in his favor on three points: the domain name was confusing with the mark “Glenn Beck”, the registrant Eiland-Hall did not have rights to the domain name, and that the domain name was registered as an act of “bad faith”. Frederick M. Abbott, the WIPO arbitrator, did rule that the domain name was confusing, but also ruled that Eiland-Hall had legitimate interest in the domain name of the website he created. “Respondent appears to the Panel to be engaged in a parody of the style or methodology that Respondent appears genuinely to believe is employed by Complainant in the provision of political commentary, and for that reason Respondent can be said to be making a political statement. This constitutes a legitimate non-commercial use of Complainant’s mark under the Policy,” said the WIPO ruling.

The WIPO decision also commented on the matter of third-party websites which may have derived profit through links from Eiland-Hall’s website, “While there is some evidence that at some stage third-party vendors of goods and services critical of [Beck] may have earned some income on sales of t-shirts and bumper stickers embodying political slogans based on click-throughs from [Eiland-Hall’s] Web site, the panel does not believe this is sufficient ‘commercial activity’ to change the balance of interests already addressed,” said the ruling.

After the WIPO ruling, Eiland-Hall decided to voluntarily relinquish ownership of the domain name and hand it over to Glenn Beck. On Friday, Eiland-Hall sent a letter to Beck, and pointed out that Beck’s actions only served to further increase publicity to the meme described on the website. “It bears observing that by bringing the WIPO complaint, you took what was merely one small critique meme, in a sea of internet memes, and turned it into a super-meme. Then, in pressing forward (by not withdrawing the complaint and instead filing additional briefs), you turned the super-meme into an object lesson in First Amendment principles,” wrote Eiland-Hall in the letter to Beck.

Eiland-Hall criticized Beck’s actions with regard to the First Amendment to the U.S. Constitution, writing, “It also bears noting, in this matter and for the future, that you are entirely in control of whether or not you are the subject of this particular kind of criticism. I chose to criticize you using the well-tested method of satire because of its effectiveness. But, humor aside, your rhetorical style is no laughing matter. In this context of this WIPO case, you denigrated the letter of First Amendment law. In the context of your television show and your notoriety, you routinely and shamelessly denigrate the spirit of the First Amendment”. He stated that he persevered in the case in order to uphold the value of the First Amendment to the U.S. Constitution, “I want to demonstrate to you that I had my lawyer fight this battle only to help preserve the First Amendment. Now that it is safe, at least from you (for the time being), I have no more use for the actual scrap of digital real estate you sought…” A representative of Beck declined to provide a comment about the WIPO ruling, after a request from PC Magazine.

Commentators likened the legal conflict between Beck and the site to the Streisand effect, a phenomenon where an individual’s attempt to censor material on the Internet in turn proves to make the material itself more public. Wendy Davis of Online Media Daily commented on the impact of the case, “The decision appears to mark a significant win for digital rights advocates because a ruling in Beck’s favor could have encouraged other subjects of online parodies to take their complaints directly to the WIPO rather than U.S. courts, which are bound by the First Amendment.” Citizen Media Law Project’s assistant director, Sam Bayard, wrote that the ruling was appropriate, “It’s good to see that this WIPO arbitrator had no interest in allowing Beck to circumvent the guarantees of the U.S. Constitution.”
